NC CAR ACCIDENT COMPLAINT – PROFFITT V. GOSNELL

Buncombe County, North Carolina – This matter involves a pedestrian who was standing on a fallen tree blocking a roadway. An inattentive driver collided with the fallen tree, causing the branches of said tree to strike the pedestrian on the back of the head with great force. Pedestrian was thrown through the air and landed in the roadway. The pedestrian suffered significant injuries. Summary Judgment was entered for the driver and the pedestrian appealed.

NC CAR ACCIDENT COMPLAINT – AVIS RENT A CAR SYSTEMS, LLC V. ANDREWS

Cabarrus County, North Carolina – On or about September 27, 2013, Vanessa Andrews was driving a vehicle that had been leased from by a New York resident, Nitsy Andrews. Vanessa Andrews caused her vehicle to strike a 2004 pickup truck, belonging to Toby Hill. Mr. Hill’s pickup truck sustained damages in excess of $10,000 as a result of the motor vehicle accident. The agreement to lease the vehicle contained a liability insurance provision that became the subject of the litigation.

Lincoln County, North Carolina – A collision occurred on July 9, 2007 between David George and Derrick Cooper. Mr. George alleged negligence arising from Mr. Cooper’s operation of his vehicle. Plaintiff filed and brought a personal injury claim against the Defendant, Pounds, alleging that the Defendant had been negligent in the operation her vehicle. The Defendant’s employer’s insurance (uninsured motorist coverage) paid over $200,000. This matter involved the satisfaction of a judgment and was appealed to the North Carolina Court of Appeals.
